Terms & Conditions

These Terms of Service ("Terms") govern your access to and use of the KortOS platform ("Platform") operated by ASJ Digital OPC ("KortOS", "we", "us"). By creating an account or using our services, you agree to be bound by these Terms.

1. Description of Service

KortOS is a software-as-a-service (SaaS) platform that enables pickleball and sports clubs ("Clubs") to manage court bookings, memberships, and player management. Club administrators ("Club Owners" or "Operators") use KortOS to operate their facilities, while players ("Members") use the platform to book courts and manage their activity.

2. Accounts and Registration

  • You must provide accurate and complete information when registering an account.

  • You are responsible for maintaining the security of your account credentials. Do not share your login details with anyone.

  • Club Owner accounts: You must be at least 18 years of age to create a Club Owner account.

  • Member accounts: You must be at least 18 years of age to create a Member account. KortOS does not currently support accounts for members under 18.

  • One person or entity may not create multiple Club Owner accounts without prior written consent from KortOS.

  • By registering, you confirm that you have read and agree to our Privacy Policy at kortos.app/privacy, which is incorporated into these Terms by reference.

3. Club Owner Responsibilities

Club Owners who subscribe to KortOS agree to:

  • Use the platform solely for legitimate club management purposes.

  • Comply with all applicable Philippine laws, including but not limited to consumer protection, data privacy, and business registration requirements.

  • Maintain accurate court schedules, pricing, and operating hours on the platform.

  • Honor confirmed bookings and communicate promptly with members regarding cancellations or changes.

  • Collect and process member personal data only in accordance with the Data Privacy Act of 2012 (Republic Act No. 10173) and the KortOS Privacy Policy at kortos.app/privacy. As a Club Owner, you are a Personal Information Controller for your members' data and are responsible for obtaining proper consent and handling data subject requests in accordance with RA 10173.

  • Breach notification: Club Owners must notify KortOS at alain@kortos.app within 24 hours of becoming aware of any actual or suspected breach of member personal data collected or processed through the KortOS platform.

4. Member Responsibilities

Members who use KortOS to book courts agree to:

  • Provide accurate personal information during registration.

  • Honor their court bookings or cancel in accordance with the Club's cancellation policy.

  • Comply with each Club's house rules and policies as published on their KortOS club page.

  • Not use the platform to harass, deceive, or harm other users.

5. Payments and Booking Fees

  • Court booking fees are set by each Club and are payable directly to the Club.

  • Online payments are processed by PayMongo, a BSP-registered payment processor, in accordance with PayMongo's terms and conditions. KortOS does not store your payment card details.

  • KortOS is a technology platform only and is not a party to the payment transaction between you and the Club.

  • Refund policies are determined by each Club. KortOS is not responsible for refund disputes between Clubs and Members.

  • Manual payment methods (GCash, Maya, bank transfer) may be accepted by Clubs at their discretion. These transactions are between you and the Club directly.

6. Platform Fees (Club Owners)

  • KortOS charges a monthly subscription fee based on your selected plan (Ligaya, Abante, or Alamat).

  • A Technology Usage Fee (TUF) is charged to the Club on all payment transactions processed through the platform, regardless of payment method, at the rate specified in your subscription plan. TUF is billed to the Club and is not charged to members.

  • All fees are due as specified in your subscription agreement. Invoices are issued monthly.

  • Failure to pay fees may result in suspension or termination of your Club's account.

  • Fee rates are subject to change with 30 days' written notice to Club Owners.

7. Third-Party Integrations

KortOS integrates with third-party services to provide platform functionality. These include but are not limited to:

  • PayMongo — payment processing

  • Google Analytics and Microsoft Clarity — analytics and UX improvement

  • DUPR (Dynamic Universal Pickleball Rating) — pickleball rating system integration. If you choose to opt into DUPR data sharing during registration or via your Profile under Privacy and Preferences, your email address will be shared with DUPR and will become subject to DUPR's own Privacy Policy and Terms of Service, available at dupr.com. KortOS is not responsible for how DUPR handles your data once it has been shared. You may withdraw your opt-in consent at any time from your Profile under Privacy and Preferences.

KortOS is not responsible for the availability, accuracy, or conduct of third-party services. Each integration is subject to the respective third party's own terms and privacy policies.

8. Prohibited Conduct

You may not:

  • Use the platform for any unlawful purpose.

  • Attempt to gain unauthorized access to other users' accounts or data.

  • Reverse engineer, decompile, or copy any part of the platform.

  • Use automated tools to scrape, crawl, or extract data from the platform.

  • Introduce malware, viruses, or disruptive code to the platform.

  • Impersonate any person or entity.

  • Manipulate court bookings or any platform data for fraudulent purposes.

9. Intellectual Property

All content, design, code, and trademarks on the KortOS platform are the property of ASJ Digital OPC and protected by applicable intellectual property laws. You may not use our name, logo, or content without prior written consent.

10. Privacy and Data Protection

Your use of KortOS is subject to our Privacy Policy at kortos.app/privacy, which explains how we collect, use, store, and protect your personal data in accordance with the Data Privacy Act of 2012 (RA 10173).

Our Data Protection Officer can be reached at alain@kortos.app for any data privacy concerns, data subject requests, or breach notifications.

11. Limitation of Liability

To the maximum extent permitted by Philippine law, ASJ Digital OPC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of data, loss of revenue, or business interruption.

Our total liability for any claim arising from your use of KortOS shall not exceed the total amount you paid to KortOS in the three months preceding the event giving rise to the claim.

Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under applicable Philippine law.

12. Suspension and Termination

  • We may suspend or terminate your account if you violate these Terms, fail to pay applicable fees, or if we are required to do so by law.

  • Club Owners may terminate their subscription with 30 days' written notice to hello@kortos.app.

  • Upon termination, your access to the platform will cease. Operators may contact alain@kortos.app to request a data export. KortOS will retain operator data for a reasonable period to allow for account recovery.

13. Changes to Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we publish a material update to our platform documents, all registered operators and members will be required to review and re-accept the updated Terms before they can continue using the platform. Access to KortOS is temporarily suspended until re-acceptance is confirmed. This ensures that your agreement to our Terms is always current.

The current version of these Terms is always available at kortos.app/terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the Republic of the Philippines. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Davao City, Philippines.
